1. Information We Collect

We collect personal information that you voluntarily provide to us when you register on the Application, express an interest in obtaining information about us or our products and services, when you participate in activities on the Application (such as submitting fitness activities, participating in chat, or managing your team) or otherwise when you contact us.

The personal information that we collect depends on the context of your interactions with us and the Application, the choices you make and the products and features you use. The personal information we collect may include the following:

• Personal Information Provided by You: We collect names; email addresses; usernames; passwords; contact preferences; and other similar information.
• Activity Data: When you participate in fitness challenges, we collect data related to your activities, such as activity type, duration, steps, and any evidence you upload (images, files).
• Team Information: If you are a team leader or member, we collect information related to your team, such as team name and member details.
• Communication Data: If you use our chat features, we may collect the content of your messages and any files or images shared.
• Uploaded Content: We collect files, images, and other content you upload as evidence for activities or share within the Application.

All personal information that you provide to us must be true, complete and accurate, and you must notify us of any changes to such personal information.

2. How We Use Your Information

We use personal information collected via our Application for a variety of business purposes described below. We process your personal information for these purposes in reliance on our legitimate business interests, in order to enter into or perform a contract with you, with your consent, and/or for compliance with our legal obligations. We indicate the specific processing grounds we rely on next to each purpose listed below.

• To facilitate account creation and logon process.
• To manage user accounts. We may use your information for the purposes of managing your account and keeping it in working order.
• To provide the Application's services. This includes tracking fitness activities, calculating points, displaying leaderboards, facilitating team competitions, and enabling chat functionalities.
• To send administrative information to you. We may use your personal information to send you product, service and new feature information and/or information about changes to our terms, conditions, and policies.
• To protect our Services. We may use your information as part of our efforts to keep our Application safe and secure (for example, for fraud monitoring and prevention).
• To respond to user inquiries/offer support to users. We may use your information to respond to your inquiries and solve any potential issues you might have with the use of our Services.
• For other Business Purposes. We may use your information for other business purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Application, products, marketing and your experience.

3. Will Your Information Be Shared With Anyone?

We only share information with your consent, to comply with laws, to provide you with services, to protect your rights, or to fulfill business obligations.

Specifically, we may need to process your data or share your personal information in the following situations:

• Team Members and Leaders: Your activity data, points, and profile information may be visible to other members of your team and your team leader for the purpose of the competition.
• Company Administrators: Designated administrators within your company may have access to user data for oversight and management of the challenge.
• Service Providers: We may share your data with third-party vendors, service providers, contractors or agents who perform services for us or on our behalf and require access to such information to do that work. Examples include: data storage (e.g., cloud storage for uploaded files), real-time communication services (e.g., for chat functionality), and analytics.
• Legal Obligations: We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process.

4. How Long Do We Keep Your Information?

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). No purpose in this notice will require us keeping your personal information for longer than the period of time in which users have an account with us, plus a reasonable period for account recovery or archival purposes.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

5. How Do We Keep Your Information Safe?

We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security, and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Application is at your own risk. You should only access the Application within a secure environment.

6. Do We Collect Information From Minors?

We do not knowingly solicit data from or market to children under 18 years of age. By using the Application, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Application. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records.

7. What Are Your Privacy Rights?

In some regions (like the European Economic Area and the UK), you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; and (iv) if applicable, to data portability. In certain circumstances, you may also have the right to object to the processing of your personal information.

8. Controls for Do-Not-Track Features

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online.

We may update this privacy notice from time to time. The updated version will be indicated by an updated "Last updated" date and the updated version will be effective as soon as it is accessible. If we make material changes to this privacy notice, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this privacy notice frequently to be informed of how we are protecting your information.
